TERMS OF USE

1. Acceptance of Terms

By accessing or using TWNTD, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any part of these terms, you are prohibited from using or accessing this platform.

2. Account Tiers & Character Allowances

TWNTD provides tiered membership levels with specific posting capabilities and character limits:

  • Standard (Free): Up to 280 characters per rant.
  • Plus: Up to 560 characters per rant.
  • Entity (Corporate Representative): Up to 5,000 characters per response/remedy.
  • Premium & Administrator: Up to 10,000 characters per post.

Users agree not to attempt to circumvent membership constraints, tier limits, or account access controls.

3. Paid Subscriptions, Billing, Renewals & Refund Policy

Certain advanced capabilities (such as Plus, Premium, and Corporate Entity tiers) require a recurring paid subscription agreement. By purchasing a subscription, you expressly agree to the following contractual terms:

  • What Is Included: Subscription access grants the specific digital feature entitlements associated with your chosen plan for the duration of the active billing period (e.g., expanded character allowances, distinct profile badges, and for verified entities, the capability to propose official Remedies and manage brand details).
  • What Is NOT Included: A paid subscription (including Corporate Entity or Premium plans) does NOT grant immunity from consumer rants, rights to censor, suppress, or delete legitimate user complaints, exemptions from community conduct rules, or any manipulation of the platform's decibel (dB) volume algorithms or community validation scores. TWNTD does not sell moderation favoritism or reputation shielding.
  • Duration & Automatic Renewal: Subscriptions are billed on a recurring basis (monthly or annually, as selected at registration or upgrade). Your subscription contract remains continuously in effect and will automatically renew at the beginning of each billing cycle unless you cancel renewal prior to the end of your current active billing term.
  • Strict No-Refund Policy: All subscription payments, setup charges, and renewal fees are fully earned upon payment and are strictly non-refundable and non-creditable to the maximum extent permitted by applicable law. No refunds, credits, or fee adjustments will be issued for partial billing cycles, mid-cycle downgrades, account abandonment, unused character capacity, or accounts suspended or terminated due to conduct or security violations.
  • Cancellation & Downgrades: You may cancel your recurring subscription renewal at any time via your account settings or by contacting billing support. Upon cancellation, your paid entitlements will remain active until the conclusion of your current prepaid billing cycle, after which your account will automatically downgrade to the Standard (Free) tier without further billing.
  • Fee Adjustments: TWNTD reserves the right to adjust subscription pricing with at least thirty (30) days' advance electronic notice to subscribers. Continued use of the subscription service following the effective date of a price change constitutes your acceptance of the updated pricing.

4. Prohibition of Automated Bots, AI Agents & Scraping

TWNTD is strictly an authentic human catharsis and peer communication platform. Any automated, robotic, or artificial intelligence interaction with the service is expressly forbidden:

  • Strict Prohibition: You must not use, deploy, or facilitate any robot, bot, crawler, scraper, automated script, headless browser, spider, artificial intelligence (AI) agent, automated LLM generation pipeline, or automated mass-interaction tool on the platform.
  • No Data Scraping or AI Training: Automated harvesting, bulk copying, data mining, or scraping of rants, comments, usernames, decibel scores, or atmospheric metrics for training machine learning or artificial intelligence models is strictly prohibited without prior express written authorization from TWNTD.
  • Enforcement & Sanctions: Any account detected utilizing bots, AI generation, automated voting, or scraping will be immediately and permanently banned without warning or right to refund. Associated IP ranges and ASNs will be blocked, and TWNTD reserves the right to pursue civil and statutory damages for unauthorized server resource consumption.

5. Corporate Entity Claims & Verification

Official brand handles (e.g., @EntityName) may be claimed by authorized corporate representatives holding eligible membership tiers (Plus, Premium, or Entity).

  • Mailbox Challenge: Claimants must verify ownership through an authorized corporate domain email address and complete time-limited (5-minute) security verification. Public webmail providers (e.g., Gmail, Yahoo, Hotmail, Outlook) are strictly prohibited for entity claims.
  • Representation Warranty: By claiming an entity, you warrant that you are legally authorized to act on behalf of the organisation. Impersonation, spoofing, or submitting fraudulent claims constitutes a material breach of these Terms and will result in immediate termination, blacklisting, and potential legal referral.
  • Administration Oversight: TWNTD reserves full discretion to review, grant, suspend, or revoke entity verification status at any time without prior notice.

6. Official Remedy Workflow & Author Autonomy

Verified corporate representatives may propose an official Remedy in response to complaints or rants lodged against their organisation.

  • Proposals: A Remedy constitutes an offer or proposed resolution submitted by the entity. Proposing a Remedy does not automatically alter or remove the original rant or rating.
  • Author Discretion: The original rant author retains absolute autonomy to Accept or Decline any proposed Remedy. If accepted, the post will display as resolved and award the author a resolution validation bonus. If declined, the complaint remains active.
  • No Guarantee of Settlement: TWNTD acts solely as a communication conduit and does not guarantee, enforce, or arbitrate remedies, refunds, customer service contracts, or legal settlements between users and entities.

7. User-Generated Content, Individual Views & Publisher Immunity (Defamation & Libel Shield)

TWNTD operates strictly as a neutral, passive forum and intermediary host for user-generated speech, consumer feedback, and community validation:

  • Individual Opinions & Views: All statements, rants, ratings, commentary, feedback, responses, and claims published on TWNTD reflect solely and exclusively the personal opinions, experiences, and views of their individual authors. They do not in any way reflect, represent, or constitute the opinions, views, endorsement, validation, or official positions of TWNTD, its founders, operators, directors, employees, or affiliates.
  • No Editorial Endorsement: TWNTD does not independently investigate, verify, fact-check, sponsor, adopt, or warrant the truth, accuracy, or completeness of any user-submitted content or corporate response.
  • Intermediary Safe Harbor: Pursuant to Section 230 of Title 47 of the United States Code (47 U.S.C. § 230), the EU Digital Services Act / Directive 2000/31/EC, the UK Online Safety Act, and equivalent safe harbor jurisprudence globally, TWNTD is an interactive computer service and intermediary, not a publisher or speaker of third-party content.
  • Complete Corporate & User Non-Liability: Under no circumstances shall TWNTD, its founders, operators, directors, employees, contractors, or agents be held legally liable to any user, consumer, brand, corporation, institution, commercial entity, or third party for any alleged loss of revenue, lost profits, business disruption, commercial injury, reputational harm, product disparagement, defamation, libel, slander, tortious interference, or any incidental, indirect, punitive, or consequential damages arising out of or related to content, reviews, or rants published by users on the platform.

8. Notice & Takedown Policy (Copyright, Trademark & Infringements)

TWNTD respects legitimate intellectual property rights and maintains a formal procedure for reviewing and addressing allegations of unlawful content, copyright infringement, or trademark misuse:

  • Submitting a Takedown Notice: Rights holders or their authorized legal agents may submit a formal takedown request to our moderation desk at [email protected] or via our in-app reporting tools. The notice must specify: (a) the exact URL and identifier of the contested post/comment; (b) the specific rights or legal grounds asserted; (c) proof of authorization; and (d) complete contact information.
  • Review Process: Upon receipt of a legally compliant notice, our moderation team will investigate and, where appropriate, restrict, redact, or remove infringing content within 48 to 72 business hours.
  • Abuse of Takedown Procedure: Submitting false, bad-faith, or fraudulent takedown demands to silence legitimate consumer criticism or public commentary constitutes a violation of these Terms and may subject the submitter to civil liability.

9. Acceptable Conduct & Moderation

TWNTD provides a space for expressing genuine consumer and public frustration regarding corporate policies, products, services, public institutions, or everyday absurdities. You agree not to post content that constitutes:

  • Doxxing or revealing private personal information (unmasked private names, personal phone numbers, physical residential addresses, or private emails) of individual employees or citizens.
  • Direct threats of violence, hate speech, or targeted unlawful harassment.
  • Spam, bot scripts, automated scraping, credential stuffing, or artificial manipulation of outrage scoring systems.

10. Automatic Anonymization & Text Processing

Names of individuals enclosed in square brackets [e.g. John Doe] are processed by our automated redaction and pseudonym engine to protect individual privacy. You acknowledge that content posted publicly is distributed across the platform feed.

11. Decibel (dB) & Solidarity (Sol) Mechanics

Sol points and dB volume scores are internal, gamified metrics designed to reflect community validation and outrage intensity. Sol points have zero monetary value and cannot be redeemed, sold, transferred, or exchanged for fiat or digital currency.

12. Corporate Brands & Intellectual Property

Trademarks, corporate names, brand handles, and service marks referenced across the platform (such as @Company, @Agency, etc.) belong to their respective owners. Reference to any brand, group, or entity does not imply sponsorship, partnership, or endorsement of TWNTD by the target entity.

Verification badges indicate only that a representative has completed corporate mailbox challenge authentication for that handle. TWNTD does not independently verify corporate claims, warranties, or the fulfillment of any proposed Remedy. All communications, customer service interactions, and remedy agreements are solely between the participating entity and the user.

13. Peer Support Nature & Limitation of Liability

By accessing or using the service, you expressly understand and agree that TWNTD provides solely a community platform for peer expression and catharsis. The service does not provide, and is not intended or designed to provide, professional healthcare, mental healthcare, psychological therapy, medical treatment, crisis intervention, counseling, or formal emotional support.

To the fullest extent permitted by applicable law, you agree to release, defend, indemnify, and hold harmless TWNTD, its founders, operators, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, demands, obligations, or expenses (including legal fees) arising out of or in connection with: (a) your use of or reliance on the platform or any user-generated content; (b) any interactions, disputes, or remedies between you and any third party or corporate entity; (c) your breach of these Terms; or (d) any mental, emotional, physiological, financial, or legal consequences resulting from your participation on the platform.

14. Non-Financial & Non-Legal Advice

Content posted on TWNTD is intended purely for public interest, consumer catharsis, and commentary. Nothing contained on this site should be construed as legal, financial, or investment advice.

15. Account Termination & Sanctions

We reserve the right to suspend, restrict, or terminate accounts and revoke entity claims that violate community guidelines, deploy unauthorized automation, engage in fraud, or attempt platform abuse.
